Supreme Court Allows Woman To Abort A 24 Week Pregnancy

The bench, after examining several reports, concluded that the foetus will not survive outside the uterus due to undeveloped skull.

In a landmark judgment, Supreme Court of India has allowed a 24 week pregnant woman to undergo abortion. As per the information, the foetus was underdeveloped and continuation of pregnancy would have been dangerous for mother’s life.

The bench of Justice S.A. Bobde and Justice L. Nageswara Rao, after examining several reports form doctors, came to the conclusion that the foetus will not survive outside the uterus due to undeveloped skull.

The 22 year woman found about the deformed foetus in December and requested for an abortion then. However, the doctors denied abortion on the ground that her pregnancy had crossed 20 weeks and hence the abortion will be illegal. Under the Medical Termination of Pregnancy (MTP) Act, the doctors can't abort the foetus if it is over 20 weeks. However, there is an exception if there is a threat to the mother’s life.
