Allahabad High Court Rules Triple Talaq Unconstitutional

Major boost to women rights as Allahabad High Court terms the Triple talaq practice unconstitutional and violates human rights

In a major ruling today Allahabad High Court today termed the Islamic practice of triple talaq as unconstitutional and said it violates human rights of Muslim women. This is a major boost to women rights and the activists who are fighting for it. The High Court said, "Triple talaq is unconstitutional; it violates the rights of Muslim women. No Personal Law Board is above the Constitution,".

While there are several NGOs and petitioners who are challenging the practice in the Supreme Court, the government has for the first time opposed the practice. The government in its statement in the Supreme Court had said, “The issue of validity of triple talaq, nikah halala and polygamy needs to be considered in the light of principles of gender justice and the overriding principle of non-discrimination, dignity and equality."

All India Muslim Personal Law Board (AIMPLB), an NGO which looks deals with the matter of Muslim personal laws in the country as opposed the government’s move.
